| metadata.dc.description.resumo: | O objetivo dessa pesquisa foi analisar o instituto da arbitragem como um método de resolução de conflitos no contexto do agronegócio e em todos os setores a ele relacionados; em especial nos conflitos que envolvem direitos patrimoniais disponíveis, reconhecidos por legislação própria. A metodologia utilizada nessa pesquisa foi a do método dedutivo; quanto aos meios a pesquisa foi bibliográfica, com uso de doutrina e legislação. Quanto aos fins, a pesquisa foi qualitativa. Conclui-se que a arbitragem representa um método eficaz na gestão das relações jurídicas do agronegócio, destacando-se um diferencial em relação à celeridade e análise técnica apurada em comparação com o Poder Judiciário brasileiro e, ainda oferece às partes a oportunidade de escolher árbitros com conhecimento específico no setor, o que assegura decisões mais adequadas e informadas. |
| Abstract: | The objective of this research was to analyze the institution of arbitration as a method of resolving conflicts in the context of agribusiness and in all sectors related to it; especially in conflicts involving available property rights, recognized by specific legislation. The methodology used in this research was the deductive method; As for the means, the research was bibliographic, using doctrine and legislation. As for the purposes, the research was qualitative. It is concluded that arbitration represents an effective method in the management of legal relations in agribusiness, highlighting a difference in relation to speed and accurate technical analysis compared to the Brazilian Judiciary and, it also offers the parties the opportunity to choose arbitrators with specific knowledge in the sector, which ensures more appropriate and informed decisions. |
