Sombras do cárcere: quando a justiça traz à luz infâncias esquecidas no contexto de privação de liberdade materna

Abstract

Maternal deprivation of liberty has serious implications for children and adolescents, often in situations of socio-economic vulnerability and rights violations. This study analyzes the role of the Judiciary in Amazonas in attending to the rights of these children and adolescents, focusing on the practices and challenges of the “Protecting Children, Transforming Lives” project, which aims to guarantee the rights of children and adolescents of women deprived of their liberty. In addition, the work proposes a reflection on the social role of women in this context. Using a qualitative-quantitative approach, data from the monitoring of this project was analyzed and observations were made in the field of non-compulsory internship. The results show significant gaps in public policies and in the coordination between the bodies that make up the protection network. They also highlight the socio-economic vulnerability experienced by these children and adolescents, who are often relegated to the background. The research highlights the need for judicial action that not only recognizes, but prioritizes the guarantee of fundamental rights for this group, reaffirming the urgency of integrated and effective actions to protect these neglected children.
